What REALTORS® Should Know About Paul Miller’s Law
Starting June 5, 2025, Pennsylvania began enforcing a new law aimed at curbing distracted driving, known as Paul Miller’s Law. This legislation, also known as the state’s hands-free driving law, prohibits the use of handheld devices while operating a motor vehicle. As professionals who spend a lot of time behind the wheel—traveling between showings, client meetings, and settlements—REALTORS® need to know how this law affects daily business on the road.
What is Paul Miller’s Law?
Named in honor of Paul Miller Jr., a young man killed by a distracted driver, the law makes it illegal to hold or support a mobile device while driving. That means no texting, emailing, scrolling, or making handheld calls—not even while stopped at a red light or in traffic.
Under the law, distracted driving includes:
- Holding or supporting a phone or tablet
- Dialing or answering a device with more than a single button press
- Reaching for a device in a way that affects your driving position
- Using apps, video, games, or social media
- Taking photos or recording videos
Even if your vehicle is momentarily stopped, if you are still in the driver’s seat on the road, these actions are considered violations.
How Will it Be Enforced?
Effective June 5, 2025 – June 5, 2026: Warnings will be issued for violations. This “grace period” is meant to educate drivers. Beginning June 6, 2026, violators will be subject to a $50 fine, plus court costs. If a distracted driver is involved in a fatal crash, the offense may carry up to five years of additional prison time. This is a primary offense, meaning law enforcement can stop and cite a driver solely for violating the hands-free rule.
Are There Exceptions?
If a driver moves the vehicle to the side of the road or off a highway and parks the car, the operator of the motor vehicle can use their cellular device. Paul Miller’s Law permits the emergency use of a mobile device when necessary to communicate with law enforcement or other emergency services to prevent injury to individuals or property.

- Invest in hands-free technology: Utilize Bluetooth or dashboard mounts to stay connected safely and legally.
- Avoid multitasking while driving: Wait until you’re parked to return texts or emails.
- Set expectations: Let clients and colleagues know you may not respond immediately if you’re driving.
